信息爆发增长催生了个性化推荐算法技术的兴起,个性化推荐算法在电子商务领域得以广泛应用。然而,个性化推荐算法的出现推动便利生活的同时,从其本质和法律属性上分析,它也必然会引发对个人权利的入侵,亟需法律做出必要的回应。在电子商务背景下对个性化推荐算法现状进行分析,发现对其法律规制存在着法律规范内涵狭窄模糊困境、意思自治困境和追责机制困境。基于以上困境,本文分别从个性推荐算法的监管者、开发者和使用者三个视角展开法律规制困境的解决路径,提升个性化推荐算法的合法性与合理性,为其的可问责性提供基础,形成从个性化推荐算法开发、实践到监管的全过程法律风险规制,为其在电子商务领域的应用进一步完善提供法理支撑。The explosive growth of information has given rise to the rise of personalized recommendation algorithm technology, and personalized recommendation algorithm has been widely used in the field of e-commerce. However, the emergence of personalized recommendation algorithms promotes convenient life. But from its essence and legal attribute analysis, it will inevitably lead to the invasion of individual rights. There is an urgent need for a legal response. In the context of e-commerce, the status of personalized recommendation algorithm is analyzed. We find that there are dilemmas of narrow and fuzzy connotation of legal norms, autonomy of meaning and accountability mechanism in its legal regulation. Based on the above dilemmas, this paper develops the solution path of legal regulation dilemmas from the three perspectives of regulators, developers and users of personalized recommendation algorithms, to improve the legitimacy and reasonableness of personalized recommendation algorithms, provide the basis of their accountability, and form the whole process of legal risk regulation from personalized recommendation algorithms’ development, practice to supervision, and to provide jurisprudential support for the application of personalized recommendation algorithms to be further perfected in the field of e-commerce. The legal support for its application in the field of e-commerce is provided by the legal theory.
